Amend CSSB 1188 (House Committee Printing) in SECTION 6 of the
bill by adding the following appropriately lettered subsection to
that SECTION and relettering subsequent subsections of that SECTION
accordingly:
( ) Subchapter A, Chapter 533, Government Code, is amended
by adding Section 533.00251 as follows:
Sec. 533.00251. PRESERVATION OF UPPER PAYMENT LIMIT
PROVISIONS OF MEDICAID PROGRAM. (a) The commission shall compute
any potential reduction or elimination of federal Medicaid payments
allowed under the upper payment limit provisions of the Medicaid
program that are made to public hospitals or other safety net
hospitals that serve recipients that might result from the
implementation of a proposal to implement or expand any Medicaid
managed care model or arrangement in a health care service region.
The commission shall consider the results of the potential
reduction or elimination in making decisions regarding the
implementation of the proposal.
(b) Before implementing a proposal described by Subsection
(a) in a health care service region that might result in a
reduction or elimination of federal Medicaid payments allowed under
the upper payment limit provisions of the Medicaid program, the
commission must submit a report regarding the proposal to the
governor, lieutenant governor, speaker of the house of
representatives, and presiding officers of each standing committee
of the senate and house of representatives having jurisdiction over
the Medicaid program.
(c) A report required under Subsection (b) must include:
(1) a description of the proposed implementation or
expansion of the Medicaid managed care model or arrangement; and
(2) the potential impact on the federal Medicaid
payments allowed under the upper payment limit provisions of the
Medicaid program.
