Amend CSSB 1354 (House committee printing) in SECTION 2 of the 
bill, in proposed Section 26.552, Water Code, by adding Subsection 
(d) (page 5, between lines 9 and 10) to read as follows:
	(d)  This subchapter does not apply to a person who:                    
		(1)  before August 31, 2005, executed a contract for the 
construction or operation of a quarry or associated processing 
plant or began construction or operation of a quarry or associated 
processing plant; and
		(2)  has a compliance history that would not otherwise 
prevent the issuance of any environmental permit.
