Amend CSSB 1433 by adding the following appropriately
numbered SECTION to the bill and renumbering subsequent SECTIONS of
the bill accordingly:
SECTION __. Section 143.005, Local Government Code, is
amended to read as follows:
Sec. 143.005. STATUS OF EMPLOYEES IF CHAPTER ADOPTED.
(a) Each fire fighter or police officer serving in a
municipality that adopts this chapter and who has been in the
service of the municipality for more than six months at the time
this chapter is adopted and who is entitled to civil service
classification has the status of a civil service employee and is not
required to take a competitive examination to remain in the
position the person occupies at the time of the adoption.
(b) Emergency medical services personnel who work in the
fire department or another municipal department of a municipality
that has adopted this chapter, and whose primary duties are to
provide emergency medical services, are considered to be members of
the fire department performing fire medical emergency technology
who are fire fighters entitled to civil service protection. Such
emergency medical services personnel shall not be considered
members of the fire fighters' bargaining unit in a municipality
that has adopted Chapter 174. Such personnel who have been in the
service of the municipality for six months on the later of the date
this chapter is adopted, or this subsection is added by amendment,
have the status of civil service employees and are not required to
take a competitive examination to remain in the positions they
occupy on that date.
(c) "Emergency medical services personnel" as used in this
Section has the meaning assigned by Health and Safety Code Section
773.003. The term applies only to individuals certified under
Chapter 773, Health and Safety Code.
(d) If emergency medical services personnel covered by this
Chapter work in a municipal department other than the fire
department, the department head of such other municipal department
will be appointed in accordance with Section 143.013, and will have
all duties assigned to the department head by this Chapter.
