BACKGROUND AND PURPOSE

 

Under current law, an individual adopted during adulthood may inherit from their biological parent, though a biological parent may not inherit from or through an adopted adult.  HB 204 would change the language so that an adopted adult may not inherit from or through the adult's biological parent.  Biological parents will still not be allowed to inherit from or through an adopted adult.  This bill will only pertain to cases where the biological parent does not have a will; if the biological parent has a will then it will be carried out to their wishes even if an inheritance is sent to the adopted adult.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

H.B. 204 amends Section 162.507 C, Texas Family Code,  so that an adopted adult may not inherit from or through the adults biological parent.  A biological parent may not inherit from or through an adopted adult.
