BACKGROUND AND PURPOSE

 

Due to the lack of zoning in Houston, neighborhoods frequently contain bars located in residential areas.  The fees for original beer and wine permits and retail dealer's on-premises licenses are extremely low and do little to deter non-serious and irresponsible business owners from applying for permits. 

 

C.S.H.B. 275 raises the fee for beer and wine permits and a retail dealer's on-premise license in counties of a certain population.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.   Amends Section 25.02, Alcoholic Beverage Code, as follows:

 

Sec. 25.02.  FEE.  (a) Provides that the annual fee for a wine and beer retailer's permit is $175, except as provided by Subsection (b) or Section 25.03.

                

(b) Provides that the state fee for a wine and beer retailer's permit for a premises located in a county with a population of 1.4 million or more is:

 

            (1)  $1,000 for an original permit; and

            (2)  $750 annually for a renewal permit.

 

SECTION 2.  Amends Section 69.02, Alcoholic Beverage Code, as follows:

 

Sec. 69.02.  FEE. (a) Provides that the annual state fee for a retail dealer's on-premises license is $150, except as provided by Subsection (b) or in Section 69.03.

 

(b) Provides that the fee for a retail dealer's on-premise license for a premises located in a county with a population of 1.4 million or more, the state fee is:

                       

            (1)  $1,000 for an original license; and

            (2)  $750 annually for a renewal license.

 

SECTION 3.   Application of the Act.

 

SECTION 4.  Effective date.

 

EFFECTIVE DATE

 

September 1, 2005.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

C.S.H.B. 275 modifies the original by adding new language providing an altered price for a wine and beer retailer's permit in counties of a certain population.

 

The substitute modifies the original by adding new language providing an altered price for a retail dealer's on-premise license in counties of a certain population.

 

The substitute modifies the original by changing the effective date of the Act to September 1, 2005, rather than immediately, or, September 1, 2005, contingent on if the Act receives the necessary vote. 

 

The substitute modifies the original by changing the caption to conform with the body of the bill.
