BACKGROUND AND PURPOSE

 

CSHB 364 makes it illegal for a person to possess an infrared transmitter (remote control) that changes the sequence of traffic lights unless that person is in connection with the official operation of an authorized emergency vehicle.

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Subchapter K, Chapter 547, Transportation Code, to prohibit the possession of “mobile infrared transmitter” unless the possession is by a person in connection with the operation of an authorized emergency vehicle or a transit vehicle operated by an authority under Chapter 451 or 452 or a transit department under Chapter 453.

 

 

EFFECTIVE DATE

 

September 1, 2005.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

CSHB 364 adds that Sec. 547.615 will not apply to a transit vehicle operated by an authority under Chapter 451 or 452 or a transit department under Chapter 453.  The original bill did not contain the transit provision.
