BACKGROUND AND PURPOSE

 

House Bill 366 standardizes the code that establishes the conditions for an offense for a person who operates a passenger vehicle and  is transporting a child.  Currently, Sections 545.412(a) and 545.413(b) have language that conflicts; this bill clarifies this problem.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Section 545.412(a) of the Transportation Code by changing the age to five and striking the word “or” and adding “and.”

 

SECTION 2. Amends Section 545.413(b) of the Transportation Code by adding the words “who is not required to be secured in a child passenger safety seat system under Section 545.412(a) and striking the words “at least five years of age but” and “or who is younger than five years of age” and “at least 36 inches in height.”

 

EFFECTIVE DATE

 

September 1, 2005.
