BACKGROUND AND PURPOSE

 

For  several years,  community colleges in Texas  have been divided into service areas which include certain counties or portions of counties in a particular region.   The purpose of creating these service areas was to determine which local community college would serve a certain population, and also to prevent community colleges from competing for students.   Although most counties in Texas are already included in a service area, much of Austin County has not been assigned to a particular community college service area.  CSHB 381 states that Blinn College will be the designated server for Austin County, excluding the Wallis-Orchard Independent School District area.  

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Strikes out "County" in title of the Act and changes it to "Blinn Junior College."  Excludes the Wallis-Orchard Independent School District from the service area of Blinn College.

 

SECTION 2.  The change in law made by this act applies beginning with the 2005 fall semester.

 

SECTION 3.  Effective date.  

 

EFFECTIVE DATE

 

This Act takes effect immediately if it receives a two-thirds vote of all members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The substitute modifies the bill caption and makes conforming changes.

 

The substitute differs from the original bill in that it changes the excluded service area from the Wharton County Junior College District to the Wallis-Orchard Independent School District.
