AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, waiver of the 72-hour waiting period for a marriage ceremony after issuance of a marriage license is strictly for military personnel and does not include any affiliates of the United States Department of Defense.  H.B. 418 allows a waiver for the 72-hour waiting period for a marriage ceremony for all employees and contract workers of the United States Department of Defense. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 2.204(b), Family Code, to provide that the 72-hour waiting period after issuance of a marriage license does not apply to an applicant who is not a member of the armed forces of the United States, but performs work for the United States Department of Defense (department) as a department employee or under a contract with the department.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date: upon passage or September 1, 2005.
