BACKGROUND AND PURPOSE

 

Currently, waiver of the seventy two hour waiting period after issuance of a marriage license is strictly for military personnel and does not include any affiliates of the United States Department of Defense.

 

House Bill 418 allows a waiver for the 72-hour waiting period for all employees and contracted workers of the United States Department of Defense.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1:              Amends Section 2.204(b),  Family Code, to include employees of and       people contracted by the United States Department of Defense as an  exception to the mandatory 72-hour waiting period.

 

SECTION 2:              This Act applies to any license issued on or after the effective date.

 

SECTION 3:              The Act takes effect immediately if it receives a vote of two-thirds of all     the members elected to each house, as provided by Section 39, Article III,  Texas Constitution. If this Act does not receive the vote necessary for     immediate effect, this  Act takes effect September 1, 2005.

 

EFFECTIVE DATE

 

September 1, 2005.
