BACKGROUND AND PURPOSE

 

Under current law, only someone holding a Railroad Commission permit can sell a new, empty liquefied petroleum gas container larger than 96 pounds water capacity.  There is no such restriction on smaller containers.

 

Removing the restriction on the larger containers makes it more convenient for the general public to purchase them.  There will be no reduction of the public’s safety since all empty containers can be filled only by persons certified by the Commission.

 

House Bill 475 would exempt the seller of any new, empty liquefied petroleum gas container from the requirement of having a Railroad Commission permit.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

Amends Section 113.081(a)(1) excludes new, empty liquefied petroleum gas containers from Railroad Commission licensing.
