BACKGROUND AND PURPOSE

 

According to precedent set by the Texas Workforce Commission, a person must be seeking full-time work to receive partial unemployment benefits. Because of this precedent, persons with disabilities that prevent them from working a full-time job are unable to receive partial unemployment benefits after being discharged from their part-time job. House Bill 481 would allow persons with disabilities who are seeking part-time work to be eligible to receive partial unemployment  benefits.

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1. Amends Chapter 207, Labor Code, by adding 207.0211 to read as follows:

 

Section 207.0211 ELIGIBILITY OF DISABLED INDIVIDUALS.  Stipulates that a disabled individual who received disability benefits under 42 USC Sec 423 and the disability limits the hours they are able to work is considered eligible for employment under SEction 207.021 (a)(4).

 

SECTION 2. Requires the claim for unemployment benefits be filed on or after the effective date of this Act.

 

SECTION 3. Provides the effective date of this Act.

 

 

EFFECTIVE DATE

 

Upon passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2005.
