BACKGROUND AND PURPOSE

 

The San Jacinto Historical Advisory Board (“Board”) was created by the legislature in 1965 simultaneously with the transfer of management jurisdiction of San Jacinto Battleground State Historic Site from the San Jacinto Park Commission to Texas Parks & Wildlife Department.  The statutory authority for the Board is now codified in Sections 22.011 through 22.015 of the Parks and Wildlife Code.  Under these statutes the Board meets quarterly to review the policies and operations of the San Jacinto Battleground and advise Parks and Wildlife Department on the proper historical development of the battleground.  In this capacity the Board is a stakeholder with the San Jacinto Museum of History Association and the Battleship Texas Foundation in the implementation of master plans affecting the future development of the park.

 

The intent of CSHB 632 is to adjust the statuary language dealing with Board to reflect its current operations.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

ANALYSIS

 

SECTION 1.

            Amends Section 22.012 to add the word "Battleground" to the name of the advisory board.

            Amends Section 22.012 to clarify that the presiding officers of the Battle Ship Texas Foundation, the San Jacinto Museum of History Association and the executive director of the Texas Historical Commission are members of the advisory board.

            Amends Section 22.012 to include the presiding officer of the San Jacinto Battleground Association.

            Amends Section 22.012 to increase the number of public members from three to four.

            Amends Section 22.012 to require that the public members serve staggered six year terms.

            Amends Section 22.012 to require that the public members have knowledge about Texas history.

            Amends Section 22.012 to require that the advisory board elect a presiding officer, vice presiding officer and a secretary.

            Amends Section 22.012 to allow for the removal of a public member due to absences.

            Amends Section 22.012 to allow the Governor to appoint a public member if a public member position is found vacant.

            Amends Section 22.012 to disallow the membership from receiving reimbursement for actual expenses incurred during the performance of official board duties.

            Amends Section 22.013 to add the word "Battleground" to the name of the advisory board.

            Amends Section 22.013 to require that the advisory board create bylaws.

            Amends Section 22.013 to require that the advisory board take minutes.

            Amends Section 22.013 to allow for nonvoting ex officio members.

            Amends Section 22.013 to require that the advisory board give timely notice of each board meeting.

            Amends Section 22.014 to allow the board to conduct an annual commemoration of the Battle of San Jacinto at the battleground and sponsor educational programs pertaining to the battle.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The substitute adds the executive director of the Texas Historical Commission to the advisory board and disallows the membership from receiving reimbursement for actual expenses incurred during the performance of official board duties.

 

EFFECTIVE DATE

 

This Act takes effect September 1, 2005.
