BACKGROUND AND PURPOSE

 

Under current law, property homeowners associations can only be established in counties with populations of 190,000 or more or in smaller counties adjacent to counties with populations of 2.4 million or more.  With the fast growth of cities in many parts of the state, many people would like to form homeowners associations but are prohibited by law from doing so.

 

The purpose of H.B. 638 is to allow people living in counties with populations of 30,000 or more to establish property homeowners associations.

 

RULEMAKING AUTHORITY

 

It is the opinion of the committee that this bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

ANALYSIS

 

SECTION 1.               Amends Section 201.001(a), Property Code, by allowing people in                                                  counties with populations of 30,000 or more to form homeowners                                                   associations.

 

SECTION 2.               Effective Date.

 

EFFECTIVE DATE

 

September 1, 2005.
