AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Under current law, an attorney of record files a form prescribed by the Bureau of Vital Statistics (bureau) for any divorce or annulment with the district clerk, who then forwards the form to the bureau.  If any information on the submitted form is incomplete or incorrect, the bureau returns the form directly to the original attorney of record for completion or correction. 

 

H.B. 723 provides that the district clerk will complete certain data if it has been omitted in the form in order to increase efficiency for the bureau, as well as lessen the chance of a form's return for correction.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 194.002(d), Health and Safety Code, to require a district clerk, if a report does not include the information required by Subsection (a)(3) or (4), to complete that information on the report before the clerk files the report with the Bureau of Vital Statistics.

 

SECTION 2.  Effective date: upon passage or September 1, 2005.
