AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

The 78th Legislature, Regular Session, 2003, enacted legislation that relocated Article 4590(i), V.T.C.S., to Chapter 74, Civil Practice and Remedies Code.  This created an antiquated cross- reference in the statutes.  It is the purpose of this bill to update the citation to Chapter 74, Civil Practice and Remedies Code.

H.B. 736 updates Chapter 84.007(e), Civil Practice and Remedies Code.

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 84.007(e), Civil Practice and Remedies Code, to replace citations to the Medical Liability and Insurance Improvement Act of Texas (Article 4590i, V.T.C.S.) with Section 74.001, Civil Practice and Remedies Code.  Makes conforming changes.

SECTION 2.  Makes application of this Act prospective.                            

SECTION 3.  Effective date: September 1, 2005.
