BACKGROUND AND PURPOSE

 

During the 78th Regular Session, legislation was enacted that moved Article 4590i, Vernon’s Texas Civil Statutes, to Chapter 74, Civil Practice and Remedies Code. Now there exists antiquated cross references in the statutes.  It is the purpose of this bill to update citations to Chapter 74, Civil Practice and Remedies Code, in Chapter 88, Civil Practice and Remedies Code.

 

HB 737 updates citations to Chapter 74, Civil Practice and Remedies Code, in Chapter 88, Civil Practice and Remedies Code.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

HB 737 amends Section 88.001(4), Civil Practice and Remedies Code, to refer to Section 74.001 and strikes 1.03(a)(3), Medical Liability and Insurance Improvement Act of Texas (Article 4590i, Vernon’s Texas Civil Statutes). Further, HB 737 amends section 88.002(k), Civil Practice and Remedies Code, to refer to Section 74.351 and strikes 13.01, Medical Liability and Insurance Improvement Act of Texas (Article 4590i, Vernon’s Texas Civil Statutes) to reflect the updated statute.  In addition, it strikes "cost bonds, deposits, and" in Section 88.002(k), Civil Practice and Remedies Code.
