AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

The 78th Legislature, Regular Session, 2003, enacted legislation that relocated Article 4590(i), V.T.C.S., to Chapter 74, Civil Practice and Remedies Code.  This created an antiquated cross- reference in the statutes.  It is the purpose of this bill to update the citation to Chapter 74, Civil Practice and Remedies Code.

 

H.B. 740 updates Chapter 578, Health and Safety Code.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 578.003(a), Health and Safety Code, to replace a citation to Sections 6.05 and 6.06, Medical Liability and Insurance Improvement Act of Texas (Article 4590i, V.T.C.S.) with Sections 74.104 and 74.105, Civil Practice and Remedies Code.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date: September 1, 2005.
