BACKGROUND AND PURPOSE

 

During the 78th Regular Session, legislation was enacted that moved Article 4590i, Vernon’s Texas Civil Statutes, to Chapter 74, Civil Practice and Remedies Code. Now there exists antiquated cross references in the statutes.  It is the purpose of this bill to update citations to Chapter 74, Civil Practice and Remedies Code, in Chapter 578, Health and Safety Code.

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

HB 740 amends Section 578.003(a), Health and Safety Code, to refer to Sections 74.104 and 74.105, Civil Practice and Remedies Code, and strikes 6.05 and 6.06, Medical Liability and Insurance Improvement Act of Texas (Article 4590i, Vernon’s Texas Civil Statutes) to reflect the updated statute.
