AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

H.B. 881 dissolves the Aransas County Conservation and Reclamation District since locally elected officials agreed that this water district no longer serves a purpose.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  DISTRICT TO BE DISSOLVED.  Requires the Aransas County Conservation and Reclamation District (district), as created by Chapter 337, Acts of the 58th Legislature, Regular Session, 1963, to be dissolved as provided by this Act.

 

SECTION 2.  TRANSFER OF ASSETS.  Requires the board of directors of the district to pay or provide for the payment of any debts or liabilities incurred by the district and transfer all of the district's remaining assets to the City of Rockport by specific dates.

 

SECTION 3.  DATE OF DISSOLUTION.  Sets forth dates on which the district is dissolved.  Requires any unsatisfied debt or legally established liability to be a charge on the assets transferred until paid.

 

SECTION 4.  REPEALER.  Repealers:

 

(1)  Chapter 337, Acts of the 58th Legislature, Regular Session, 1963;

 

(2)  Chapter 582, Acts of the 62nd Legislature, Regular Session, 1971; and

 

(3)  Chapter 271, Acts of the 66th Legislature, Regular Session, 1979.

 

SECTION 5  EFFECTIVE DATE.  Effective date: upon passage or September 1, 2005.
