BACKGROUND AND PURPOSE

 

The Property Code requires notice to the attorney general of any proceeding involving a charitable trust within 30 days of the filing but not less than 10 days prior to a hearing.

 

The purpose of this bill is to amend the law to allow additional time for the attorney general to review the petition or other instrument.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill amends Section 123.003(a) and (b) of the Property Code by increasing the minimum notice to the attorney general under such statutes from 10 days to 25 days.

 

EFFECTIVE DATE

 

September 1, 2005

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The original version of the bill increased the notice to 15 days; this version raises it to 25.
