BACKGROUND AND PURPOSE
During the 78th Legislative Session an antique boat designation was created in the Parks and Wildlife Code to allow boat owners an alternative placement for a required registration decal. A registration decal is typically required to be placed on each side of the bow of a boat and was seen as a hindrance to the proper restoration of an antique boat.
The current definition lists a specific year, 1968, as the standard for achieving an antique boat designation. The problem associated with specification of a certain year is that the classification does not allow other boats as they age to fall under the antique designation.
H.B. 942 amends the Parks and Wildlife Code to better reflect the intent of the antique boat provision. The bill establishes that any boat built 35 or more years before the date of the registration decal is considered to be an antique boat.
RULEMAKING AUTHORITY
It is the opinion of the committee that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
SECTION 1. Changes the designation of an antique boat from one manufactured in 1968 or before to one manufactured 35 or more years before the date of a current registration decal.
