AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

The Texas Parks and Wildlife Department is often called upon to assist the families of deceased individuals with the transfer of ownership of boats and outboard motors.  Currently, the process by which the transfer is facilitated is cumbersome and difficult to administer.

 

H.B. 943 provides the Texas Parks and Wildlife Department with the ability to administer a more efficient process for documenting and transferring ownership of estate property pertaining to boards and outboard motors when the administration of an estate is not required.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 31.047, Parks and Wildlife Code, by adding Subsection (g), as follows:

 

(g)  Requires an affidavit, if administration of an estate is not required by law, to be submitted under Subsection (c) (certain evidence showing entitlement to a certificate of title or a security interest) to include a showing that the administration is not required, identification of all heirs, and a statement by the heirs of the name in which to issue the certificate.

 

SECTION 2.  Effective date: upon passage or September 1, 2005.
