BACKGROUND AND PURPOSE

 

Chapter 284 of the Transportation Code governs, among other things, the operation of toll roads by counties or toll road authorities created by counties.  Concurrent with their power to construct and operate toll roads, counties are able to assess an administrative penalty against the registered owner of any vehicle that uses a county toll road without first paying the required toll.

 

After conducting an administrative hearing for failure to pay a posted toll, Section 284.209, Transportation Code, currently allows the hearing officer to issue a decision rendering one of three enforcement measures:  placing a device that prohibits movement of a motor vehicle on the vehicle, imposing an additional fine if the fine for the offense is not paid with a specified time or refusing to allow the registration of the vehicle.  HB 958 amends the Transportation Code to allow the hearing officer to issue a decision utilizing all three enforcement measures.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends the Transportation Code by amending Section 284.209(2) by striking “or” and inserting “and”.

 

SECTION 2.  Provides an effective date.  This bill applies to violations that occur on or after the effective date of the bill.  Otherwise, the law as it existed immediately before the effective date applies to violations of an order that occurred before the effective date.

 

EFFECTIVE DATE

 

September 1, 2005.
