BACKGROUND AND PURPOSE
H.B. 960 would allow a county with a population of 3.3 million or more to build or renovate a building that is located in another political subdivision without notice or permit if the project is supervised and inspected by a licensed engineer or architect. The county must comply with building standards.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
SECTION 1. Amends Chapter 245, Local Government Code, by adding Section 245.007 which only applies to a building or facility that is owned by a county with a population of 3.3 million or more, and is located within the boundaries of another political subdivision. It prohibits a political subdivision from requiring a county to notify or obtain a building permit for any new construction or renovation of a building or facility owned by the county if the construction or renovation is supervised and inspected by an engineer or architect. A county is not exempt from complying with the building standards of the political subdivision.
SECTION 2. Effective Date
EFFECTIVE DATE
Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2005.
