BACKGROUND AND PURPOSE
When a person purchases an automobile, the seller has a duty to apply, in the name of the purchaser of the vehicle, for the registration. A person who purchases a vehicle in a county other than the one they reside in will often receive a title from the county the vehicle was purchased.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
SECTION 1. Requires a seller of motor vehicles who applies for a certificate of title on behalf of the buyer, to apply in the county in which the purchaser lives unless the purchaser makes a written request stating otherwise.
SECTION 2. Effective date.
EFFECTIVE DATE
September1, 2005.
COMPARISON OF ORIGINAL TO SUBSTITUTE
The substitute requires the application for certificate of title to be made in the county in which the buyer lives unless the purchaser makes a written request stating otherwise. The original gave the choice of county of domicile, the county of purchase, or the county in which the vehicle was encumbered.
