AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

Pursuant to Section 59, Article XVI, Texas Constitution, H.B. 1054 creates a conservation and reclamation district to be known as Montgomery County Municipal Utility District No. 101.  Land located in the proposed district's boundaries is undeveloped, and the creation of the district would facilitate the provision of utility services to future residential communities.  The district would have all the rights and powers granted to municipal utility districts in Chapter 49, Water Code.  However, the district would not have the ability to invoke eminent domain authority to acquire land outside the district boundaries.

RULEMAKING AUTHORITY

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
