AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Current Texas law gives the Texas Parks and Wildlife Commission (commission) discretion to waive or lower fees for hunting and fishing licenses for certain individuals.

 

Military service members on active duty are not among the individuals eligible for these benefits under current law.  As a token of appreciation for the sacrifices being made by active duty Texas service members, H.B. 1076 directs the commission to waive all fees for hunting and fishing licenses for Texas residents currently on active duty as a member of the military.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 42.012(b), Parks and Wildlife Code, to require the Parks and Wildlife Commission (commission) to waive the general hunting license fee for a resident on active duty as a member of the United State military forces.

 

SECTION 2.  Amends Section 46.004(c), Parks and Wildlife Code, to require the commission to waive the fishing license fee for a resident on active duty as a member of the United States military forces.

 

SECTION 3.  Effective date:  September 1, 2005.
