BACKGROUND AND PURPOSE

 

Currently, in a municipality that has adopted civil service, a person who is 45 years of age or older may not be certified for a beginning position in a police department and a person who is between the ages of 36 and 45 may not be certified as eligible for a beginning position in a police department unless the person has at least five years' experience as a peace officer or at least five years of military experience.

 

C.S.H.B. 1151 makes all person eligible for beginning positions in a police department that has adopted civil service if they are under the age of 45 years of age.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

C.S.H.B. 1151 amends Section 143.022, Local Government Code, to make all person eligible for a beginning position in a police department in a municipality that has adopted civil service if they are under the age of 45 years of age.

 

EFFECTIVE DATE

 

This Act takes effect September 1, 2005 or immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The substitute removes language effecting age restrictions for beginning positions in a fire department.  In addition, the original version of the bill removed all age restrictions for beginning positions in civil service police departments while the substitute retains a 45 year age limit.
