AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, the Railroad Commission of Texas (commission) is required to adopt rules providing requirements regarding attendance at training, examination, and seminars for persons who wish to be licensed or registered under Section 116.034(a), Natural Resources Code.  The statute requires the commission to operate continuing-education programs for CNG and LNG certificate holders as well as for LP-gas certificate holders.

 

 H.B. 1162 authorizes commission to operate CNG and LNG continuing-education programs.

 

RULEMAKING AUTHORITY

 

Rulemaking authority previously granted to the Railroad Commission of Texas is modified in SECTION 1 (Section 116.034, Natural Resources Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 116.034(a), (c), and (h), Natural Resources Code, as follows:

 

 (a)  Authorizes, rather than requires, the Railroad Commission of Texas (commission) to adopt rules providing training and seminar attendance requirements.  Requires the commission to adopt rules providing examination requirements for persons who are required or who wish to be licensed or registered under this chapter.  Deletes existing text relating to the commission adopting rules providing examination requirements.

 

            (c)  Makes a nonsubstantive change.

 

            (d)  Makes a conforming change.

 

SECTION 2.  Effective date: September 1, 2005.
