BACKGROUND AND PURPOSE
Currently, the Railroad Commission of Texas is required to adopt rules providing requirements regarding attendance at training, examination, and seminars for persons who wish to be licensed or registered under Section 116.034(a), Natural Resources Code. The statute requires the Commission to operate continuing-education programs for CNG and LNG certificate holders as well as for LP-gas certificate holders. H.B. 1162 authorizes rather than requires the Commission to operate CNG and LNG continuing-education programs.
RULEMAKING AUTHORITY
It is the committee's opinion that rulemaking authority is expressly granted to the Railroad Commission of Texas in SECTION 1 (Section 116.034(a), Natural Resources Code) of this bill.
ANALYSIS
SECTION 1. Amends Section 116.034 (a), Natural Resources Code, authorizing the Railroad Commission of Texas to adopt rules regarding attendance requirements and requires the commission to adopt rules providing examination requirements
(h) authorizes the commission to recognize, prepare, or administer continuing education programs for its licensees and registrants.
EFFECTIVE DATE
September 1, 2005
COMPARISON OF ORIGINAL TO SUBSTITUTE
Clarifies that the Commission is required, instead of authorized, to adopt rules providing examination requirements for persons who are required or wish to be licensed or registered under this chapter.
Amends Section 116.034(h) to require instead of authorize the commission.
