AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Currently, Chapter 701, Transportation Code, limits a county to the employment of not more than five county traffic officers who are dedicated to the enforcement of highway traffic safety.

 

H.B. 1165 excludes counties with a population of two million or more from the officer-limit provision.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 701.001, Transportation Code, as follows:

 

Sec. 701.001.  AUTHORIZATION.  (a)  Authorizes the commissioners court of a county, except as provided by Subsection (c), acting in conjunction with the sheriff of the county, to employ not more than five regular deputies as county traffic officers.

 

(b)  Makes a conforming change.

 

(c)  Provides that the limitation on the number of deputies that may be employed under Subsections (a) and (b) does not apply to a county with a population of more than two million.

 

SECTION 2.  Effective date:  upon passage or September 1, 2005.
