BACKGROUND AND PURPOSE

 

Currently, the Texas Industrial Fire Training Board serves as an advisory board to the State Firemen’s and Fire Marshals’ Association of Texas.  The name of the board is not inclusive of Emergency Medical Services (EMS) personnel or other emergency personnel, but only includes members of a fire brigade.  The Board recommended that the name be changed to The Texas Industrial Emergency Services Board to better reflect the make-up of the board and it’s membership.  The name change was approved by a Constitution and By-Laws changed at the 2003 State Firemen’s and Fire Marshals’ Association Training Conference and Convention.  H.B. 1267 makes the necessary statutory changes to reflect the new name.     

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 775.032(a), Health and Safety Code by changing the name of the Texas Industrial Fire Training Board to the Texas Industrial Emergency Services Board.

 

SECTION 2.  Amends Section 776.032(a), Health and Safety Code by changing the name of the Texas Industrial Fire Training Board to the Texas Industrial Emergency Services Board.

 

SECTION 3.  Amends Section 541.201(1), Transportation Code, by changing the name of the Texas Industrial Fire Training Board to the Texas Industrial Emergency Services Board, and stating that an industrial emergency response vehicle must be operated in compliance with criteria of the predecessor of the Texas Industrial Emergency Services Board for it to be considered an authorized emergency vehicle.

 

SECTION 4.  Provides that reference in another law or administrative rule to the Texas Industrial Fire Training Board means the Texas Industrial Emergency Services Board.
