AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Approximately 60 percent of children in the United States under the age of six attend child or day care programs.  These are settings in which children come into close contact with one another facilitating the exchange of both viral and bacterial infection as they share toys and  play on equipment.  According to the Centers for Disease Control, children in childcare settings are three times more likely to contract pneumococcal disease, including pneumococcal meningitis. 

 

Currently, pneumococcal disease and hepatitis A are the only vaccines recommended by the American Academy of Pediatrics Advisory Committee on Immunization Practices that are not included in the immunization required under state law. 

 

H.B. 1316 adds a vaccination for invasive pneumococcal disease and hepatitis A to the list of required vaccines for children in regulated child-care facilities. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

[While statutory reference in this bill is to the Department of Protective and Regulatory Services (DPRS), the following amendments affect the Department of Family Protective Services, as the successor agency to DPRS.]

 

SECTION 1.  Amends Section 42.043(b), Human Resources Code, to include invasive pneumococcal disease and hepatitis A amongst the immunizations the Department of Protective and Regulatory Services is required to ensure is given to each child, as recommended by the Department of State Health Services, rather than the Texas Department of Health. 

 

SECTION 2.  Effective date:  September 1, 2005.
