AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

H.B. 1318 amends Section 431, Government Code, by providing grave markers for members of the state military forces who have served the State of Texas.  It also states that only those who are not eligible for federal markers may receive a state marker.  Finally, it allows for markers to be provided by the adjutant general, and allows the adjutant general to adopt rules to implement this Act.

 

RULEMAKING AUTHORITY

 

Rulemaking authority is expressly granted to the adjutant general in SECTION 1 (Section 431.0175, Government Code) of this bill.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Subchapter A, Chapter 431, Government Code, by adding Section 431.0175, as follows:

 

Sec. 431.0175.  GRAVE MARKERS FOR STATE MILITARY PERSONNEL.  (a)  Requires the adjutant general to provide a grave marker for a decedent who served in the state military forces on the request of certain individuals.

 

(b)  Authorizes certain individuals to request a grave marker from the adjutant general.

 

(c)  Provides that a person is not eligible for a grave marker under this section if the person is eligible for a grave marker under federal law.

 

(d)  Requires the adjutant general to model the grave markers after the grave markers provided by the federal government.

 

(e)  Requires the adjutant general to adopt rules to implement this section.

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date: September 1, 2005.
