BACKGROUND AND PURPOSE

 

Currently, Transportation Code 472.031 authorizes a metropolitan planning organization to include in its bylaws the appointment of voting proxies for its members. CSHB 1339 narrows the scope of a proxy for legislative policy board members. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Chapter 472, Transportation Code, by adding Section 472.031 for a voting proxy by a legislative policy board member of a metropolitan planning organization.  Subsection (c) provides specific language that authorizes a legislative policy board member to appoint a proxy who is a legislative member's employee or staff member, or another member of the policy board.

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2005.

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The substitute allows a legislative policy board member to appoint a non-legislative policy board member in response to the questions by Committee members.  The original draft limited proxies to legislative members employees and staff members, and other legislative members.   Under the substitute, any member of the board could serve as a proxy.
