AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

During the 76th Legislature, Regular Session, 1999, H.B. 3262 amended the Health and Safety Code to protect copies of rabies vaccination records held by city and county governments from disclosure under the Open Records Act.  However, a recent open records ruling by the attorney general negated the effect of the bill.  In doing so, it took away the protection that Section 826.0211 (Confidentiality of Certain Information in Rabies Vaccination Certificate; Criminal Penalty), Health and Safety Code provides.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 826.0211(a), Health and Safety Code, to provide that information contained in a rabies vaccination certificate or in any record compiled from the information contained in one or more certificates that identifies or tends to identify an, rather than the, owner or an address, telephone number, or other personally identifying information of an owner of a vaccinated animal is confidential and not subject to disclosure under Chapter 552 (Public Information), Government Code.  Makes conforming and nonsubstantive changes.

 

SECTION 2.  Effective date:  upon passage or September 1, 2005.
