BILL ANALYSIS
BACKGROUND AND PURPOSE
House Bill 3262, passed by the 76th Legislature in 1999, added Section 862.0211 to the Health & Safety Code to protect copies of rabies vaccination records held by city and county governments from disclosure under the Open Records Act. However, a recent Attorney General Open Records letter ruling negated the effectiveness of the bill, and took away the protection that Section 862.0211 of the Health & Safety Code provides.
HB 1426 restores protection to all copies of animal records held by municipal or county governments under the Open Records Act.
RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.
ANALYSIS
This bill amends Health & Safety Code to add any record compiled from the information contained in one or more certificates to documents not subject to disclosure under the Open Records Act.
EFFECTIVE DATE
This Act takes effect immediately upon passage or September 1, 2005.
