BACKGROUND AND PURPOSE

 

Under current law, the powers, duties, rights, responsibilities, processes, etc. of property owners' associations pertaining to restrictive covenants apply to subdivisions in counties with populations of 2.8 million or more or in counties with populations of 250,000 or more that are both adjacent to the Gulf of Mexico and counties with populations of 2.8 million or more.

 

The purpose of C.S.H.B. 1632 is to include counties with populations of 275,000 or more that are adjacent to counties with populations of 3.3 million or more and contain part of a national forest.

 

RULEMAKING AUTHORITY

 

It is the opinion of the committee that this bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

ANALYSIS

 

SECTION 1.                           Amends Section 204.002(a), Property Code, as follows:

 

                                                The applicability of this chapter is expanded to include counties with populations of 275,000 or more, adjacent to counties with populations of 3.3 million or more and contain part of a national forest.

 

SECTION 2.                           Effective Date.

 

EFFECTIVE DATE

 

September 1, 2005.
