BACKGROUND AND PURPOSE

 

Currently, there is some confusion by residents of this state about what is required in order to prove residency when purchasing a hunting or fishing license.

 

H.B. 1636 allows the Texas Parks and Wildlife Commission to establish by rule any requirements necessary to clear up this current confusion.

 

RULEMAKING AUTHORITY

 

It is the opinion of the author that rulemaking authority is expressly granted to the Texas Parks and Wildlife Commission in SECTION 1 of this bill.

 

ANALYSIS

 

SECTION 1. Amends Subchapter A, Chapter 11, Parks and Wildlife Code by adding Subsection 11.004 which states that the commission by rule may prescribe the proof required to demonstrate residency in this state for obtaining a license or permit issued by the department.

 

SECTION 2. Effective Date

 

EFFECTIVE DATE

 

Upon passage, or, if the Act does not receive the necessary vote, the Act takes effect September 1, 2005.
