AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

The Texas Department of Transportation (TxDOT) designated United States Highway 80 as the "World War II Veterans Memorial Highway" by Minute Order 20774 on August 1, 1944.  No further action was taken on this designation.  H.B. 1645 places this designation in statute and requires TxDOT to erect signs along the highway reflecting the designation, contingent upon the receipt of grants or private donations.

 

The current route of United States Highway 80 runs from the Texas-Louisiana border in Harrison County to the intersection of United States Highway 80 and United States Highway 130 in Dallas County.  H.B. 1645 designates the portion of United States Highway 80 that travels through Texas as the "World War II Veterans Memorial Highway" in honor of veterans of World War II.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter B, Chapter 225, Transportation Code, by adding Section 225.0285, as follows:

 

Sec. 225.0285. WORLD WAR II VETERANS MEMORIAL HIGHWAY.  (a) Designates the section of United States Highway 80 located in this state as the World War II Veterans Memorial Highway.

 

(b) Requires the Texas Department of Transportation (TxDOT) to design and construct memorial markers indicating the highway number, the designation as the World War II Veterans Memorial Highway, and any other appropriate information.

 

(c) Requires TxDOT to erect a marker at each end of the highway and at each county line crossed by the highway, except as provided by Subsection (d).

 

(d) Provides that TxDOT is not required to design, construct, or erect a marker under this section unless certain private funds are available.

 

(e) Requires money received under Subsection (d) to be deposited to the credit of the state highway fund.

 

SECTION 2. Effective date: September 1, 2005.
