AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

The definition for "all-terrain vehicle" (ATV) provided in Section 502.001(1), Transportation Code, does not reflect changes in the design of some newer ATV models.

 

H.B. 1646 amends the definition of ATV to accurately reflect the models currently being manufactured.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 501.002(14), Transportation Code, redefines "motor vehicle" to include an all-terrain vehicle, rather than a four-wheel all-terrain vehicle, as defined by Section 502.001.

 

SECTION 2.  Amends Section 502.001(1), Transportation Code, by redefining "all-terrain vehicle" to include a vehicle equipped with a saddle or bench, designed to propel itself with three or more, rather than four, tires, and not designed by the manufacturer primarily for farming or lawn care.

 

SECTION 3.  Effective date:  September 1, 2005.
