AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Section 141.074, Agriculture Code gives the Texas Feed and Fertilizer Control Service (service) the authority to require each licensee to maintain records or file additional reports for the purpose of determining the accurate tonnage of commercial feed distributed in this state or identify or verify tonnage reports.  The service is entitled to examine at reasonable times those records maintained under this section.  
 
H.B. 1733 exempts those records and reports maintained under Section 141.074 from mandatory disclosure under Chapter 552 of the Government Code.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 141.074, Agriculture Code, by adding Subsection (e), as follows:

 

(e)  Provides that a record or report maintained or filed under this section is confidential and not subject to required disclosure under Chapter 552 (Public Information), Government Code.

 

SECTION 2.  Effective date: upon passage or September 1, 2005.
