BACKGROUND AND PURPOSE

 

House Bill 1737 establishes guidelines for a junior college district to create an educational facility within its district, and then, in order to maximize and fully utilize the new facility, be allowed to open it to usage by other entities within its district or by educational partners throughout the region.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1 - States that upon approval from the Texas Higher Education Coordinating Board, the board of trustees of a junior college district may establish and operate a dual usage educational complex to provide a shared facility for the educational activities of the district and other participating entities. They may then establish a cooperative agreement governing the operation and use of the complex with participating entities, as well as sharing the use and cost associated with the establishment and operation of the complex. 

 

SECTION 2 – Effective date.

 

EFFECTIVE DATE

 

This Act takes effect immediately if it receives a two-thirds vote of all members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
