BACKGROUND AND PURPOSE

 

The Health and Safety Code currently requires all nursing homes and related institutions to post for display in a public area of the institution that is readily available to residents, employees and visitors, any information regarding the compliance status of the institution.  C.S.H.B. 1756 would require that, in addition to posting the compliance status of the institution in a public area of the institution, the information would be posted on the Department of Aging and Disability Services (DADS) website and would be updated on a monthly basis.

 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

The bill requires DADS to post detailed compliance information regarding each institution licensed by DADS on the DADS website, and further requires DADS to update the website once a month to provide the most current compliance information regarding each institution.

 

 

EFFECTIVE DATE

 

September 1, 2005

 

COMPARISON OF ORIGINAL TO SUBSTITUTE

 

The original bill provides that the website shall be updated "as necessary" to provide the most current compliance information.  The substitute bill provides that the website shall be updated "once a month" to provide the most current compliance information.
