AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

Current Texas law authorizes the Texas Department of Public Safety (DPS) to issue a sticker for a license of an individual who has changed his or her address and to issue a disability health certificate to an individual who has a disability or health condition that impairs the ability to drive.

 

H.B. 1789  repeals such requirements since these licenses and certificates have never been requested.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 521.054(b), Transportation Code, to delete a reference to Section 521.054(d).

 

SECTION 2.  Amends Section 521.424, Transportation Code, to delete a fee for a duplicate disability certificate or duplicate health condition certificate.

 

SECTION 3.  Repealer:

 

(1)  Sections 521.054(d) (relating to applying for a duplicate license or certificate), (e) (relating to payment for duplicate license or certificate), and (f) (relating to the forms required under Subsection (d)), Transportation Code;

 

(2)  Section 521.102 (Disability or Health Condition Certificate), Transportation Code; and

 

(3)  Section 521.423 (Fee for Disability Certificate or Health Condition Certificate); Transportation Code.

 

SECTION 4.  Effective date: September 1, 2005.
