BACKGROUND AND PURPOSE

 

Current law does not restrict school districts from using resources to construct, maintain, or repair improvements to real property outside of the bounds of their school district.  In one extreme case, a school district maintenance division is acting as a construction company for another school district. 

 

HB 1826 allows resources of school districts to remain with the school district for the betterment of the district.  This bill prohibits school districts from using their resources on property not owned or leased by the district. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

HB 1826 amends the education code by prohibiting the board of trustees of a school district from authorizing the use of school district employees, property or resources for repair, maintenance, or construction of improvements to real property not owned or leased by the district.

 

EFFECTIVE DATE

 

This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution.  If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2005.
