BACKGROUND AND PURPOSE

 

Currently, Chapter 391.252 (a), Transportation Code, bans the construction of new billboards on certain sections of Texas highways.  HB 1851 simply adds State Highway 90 from the western city limits of San Antonio to the eastern city limits of Hondo to that list.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

SECTION 1.  Amends Section 391.252 (a), Transportation Code, to prohibit a person from erecting an off-premise sign that is adjacent to and visible from State Highway 90 from the western city limits of San Antonio to the eastern city limits of Hondo to that list.

 

Deletes text regarding the effective date of this Subchapter.

 

EFFECTIVE DATE

 

SECTION 2.  Effective date is September 1, 2005
