BACKGROUND AND PURPOSE

 

Under current law, a junked vehicle is a public nuisance punishable by a fine not to exceed $200.  Because of the minimal consequences, many unsightly vehicles fitting this description are left in parking lots and neighborhood streets.  This bill would raise the penalty for a junked vehicle offense to a Class C misdemeanor, punishable by a fine by a fine not to exceed $500. 

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. 

 

ANALYSIS

 

This bill amends Section 683.073 (b) of Transportation Code, increasing the criminal penalty for a junked vehicle offense to a Class C misdemeanor.

 

EFFECTIVE DATE

 

September 1, 2005.
