AUTHOR'S/SPONSOR'S STATEMENT OF INTENT

 

In previous legislative sessions, conflicting laws were passed relating to nonprofit water supply and sewer service corporations.  H.B. 2045 reinstates the intent of the original legislation and resolves any unintended contradiction in the law by deleting language in the Business Organizations Code which states that the act does not apply to nonprofit water supply and sewer service corporations. 

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Section 2.010, Business Organizations Code, by deleting text prohibiting a nonprofit corporation from being organized or registered under this code to conduct its affairs in this state to engage in water supply or sewer service as an entity under Chapter 67 (Nonprofit Water Supply or Sewer Service Corporations), Water Code.  Makes conforming changes.

 

SECTION 2.  Effective date:  January 1, 2006.
